A federal court in Florida has sentenced the president of Lateral Investments LLC to 18 months in prison and ordered him to pay a $10,000 criminal fine and forfeit illegal proceeds of $935,240 for knowingly importing approximately 278,256 kilograms of illegal hydrochlorofluorocarbon (HCFC-22). According to court records, the defendant admitted to smuggling the illegal HCFC-22 from China between June and August 2007. Under the Montreal Protocol, EPA established a schedule to phase out the production and importation of ozonedepleting substances, with a total phase out in 2030. To legally import HCFC-22 for consumption, one must hold and expend one consumption allowance for each kilogram of HCFC-22 imported into the United States.
