In our Spring issue, we reported on the increase in the rent threshold for assured tenancies to £100,000 per annum with effect from 1 October. The Department for Communities and Local Government had stated that tenancy deposits taken in connection with tenancies which were converted into assured shorthold tenancies by the threshold increase would now need to be placed into an authorised tenancy deposit scheme. We pointed out that it was arguable that the Department’s interpretation was not correct and now our view has been borne out by further information issued by the Department saying they do not consider that such deposits would need to be protected but that ultimately it will be for the courts to decide.
