Nexsen Pruet intellectual property attorney Sarah Nagae shares insight and overviews of trademarks and the trademark process as part of a recurring Tuesday series, "Trademark Tuesday."
In this year's first video in the #TrademarkTuesday series, Sarah explains how to choose and establish your trademark.
The first step is to generate a name, logo or, if you aren’t quite there yet, a branding theme or general idea of what you want to convey through your brand. At this point, Sarah recommends engaging a trademark attorney to help you with a trademark clearance search to see if any similar trademarks may already exist and how much risk might be involved in using the mark or marks you are considering. Finally, it is helpful for your legal and design teams to work together collaboratively throughout the brand development process to ensure that the final trademark is one that you will be able to safely use and protect.
