From 1 January 2019 a mandatory disclosure pilot is running in the Business and Property Courts of England and Wales. The pilot disclosure rules, detailed in the new Practice Direction 51U to the Civil Procedure Rules, are intended to address the increasing burdens parties face under the standard disclosure regime by making disclosure a more focused and bespoke part of the proceedings. Outside the Business and Property Courts the normal disclosure regime continues in force. For parties and their lawyers undertaking disclosure which is subject to the pilot, the timeline below offers a helpful overview of the new process.
