On July 13th, the Seventh Circuit affirmed the entry of summary judgment dismissing plaintiff's claims that his mortgage servicer breached the terms of the parties' mortgage and forbearance agreements by reporting his late mortgage payments to credit bureaus and assessing penalties. Because the mortgage agreement allowed the servicer to apply payments in the order they were due, plaintiff's two missed payments still existed even though he was current under the forbearance agreements.
