On September 7th, the Eleventh Circuit vacated a district court's dismissal of a complaint seeking to forestall the foreclosure of a home. The plaintiff originally filed an emergency petition in state court to enjoin the foreclosure. Because the plaintiff's petition referenced federal lending laws, the defendants removed the case to federal court where it was dismissed. Vacating the district court decision, the Eleventh Circuit held that the federal court lacked jurisdiction because although the petition referenced federal laws, none of the claims relied on federal law.
