Ryanair has lodged two actions before the CFI seeking a declaration that the Commission failed to act on competition complaints. Ryanair had complained to the Commission that differential airport charges based on flight destinations, levied by French airports, unfairly advantaged Air France and that exclusive use of terminal 2 at Munich airport had the same effect for Lufthansa and its Star Alliance partners. Ryanair’s complaint was that both acts constituted unlawful state aid or in the alternative amounted to anti-competitive discrimination contrary to Article 82.
