Climate Change Response (Emissions Trading and Other Matters) Amendment Bill

This Bill implements a number of changes to New Zealand's Emissions Trading System (ETS).  These were announced by the Government in July, following its consideration of the ETS Review Panel's report.  Key changes include:

  • maintaining beyond 2012 the one-for-two surrender obligation in respect of carbon units  emitted (without specifying an end date);
  • maintaining the $25 'fixed-price option' until at least 2015, capping the price firms will pay if carbon prices begin to rise internationally;
  • introducing off-setting for pre-1990 forest land owners, and allocating the full second tranche of compensation where off-setting is not taken; and
  • leaving agricultural emissions out of the ETS until at least 2015

Income Tax (Universalisation of In-work Tax Credit) Amendment Bill

This Bill would amend the Income Tax Act 2007 by extending the in-work tax credit (IWTC) to beneficiaries and student families with children.  The IWTC is part of the Working for Families package, currently available only to working families (two parent families working more than 30 hours between them, or single parent families working more than 20 hours).

Land Transport Management Amendment Bill

This Bill would amend Land Transport Management Act 2003 and has three main components.

  • It would amend the planning and funding framework for land transport investment.  This includes new decision-making criteria, the consolidation of regional land transport strategies and regional land transports programmes into new regional land transport plans, and the consolidation of the national land transport strategy and the government policy statement into a single government policy statement on transport.  The Act's provisions for regional fuel taxes would be repealed.
  • The Bill provides a new process and a new statutory test for the approval of road tolling schemes.
  • The Bill proposes to establish a new policy framework for planning and contracting public transport.  In particular, all bus, ferry and rail services in a region will be required to be segmented into units and provided under exclusive contract to a regional council.  The Bill would repeal the Public Transport Management Act 2008.

Local Government (Council-Controlled Organisations) Amendment Bill

This Bill would amend the Local Government Act 2002 by repealing the exclusion of port companies and their subsidiaries from the Act's definition of "council controlled organisation" (CCO).  As CCOs, port companies would become subject to some provisions contained in the Local Government Act 2002, and would be subject to the Local Government Official Information and Meetings Act 1987 (the local government equivalent of the Official Information Act 1982).

ori Television Service (Te Aratuku Whakaata Irirangi Māori) Amendment Bill

This Bill proposes to implement a number of changes to the Māori Television Service (Te Aratuku Whakaata Irirangi Māori) Act 2003, as recommended by a three-person panel appointed to review the Act in 2009.  These changes include:

  • the strengthening of the Service's function in respect of the linguistic integrity of te reo Māori;
  • the Crown's transfer of UHF spectrum management rights to Te Pūtahi Paoho (the Māori Television Electoral College) for the establishment of a digital terrestrial television network; and
  • additional powers and flexibility to borrow funds.

Ngāti Whātua o Kaipara Claims Settlement Bill

This Bill gives effect to the deed of settlement entered into by the Crown and Ngāti Whātua o Kaipara on 9 September 2011 for the final settlement of the historical claims of Ngāti Whātua o Kaipara.  Ngāti Whātua o Kaipara's rohe is on the North Island's west coast, between the Waitemata and Kaipara harbours.

Reserve Bank of New Zealand (Amending Primary Function of Bank) Amendment Bill

This Bill would amend the Reserve Bank's primary function, prescribed by section 8 of the Reserve Bank of New Zealand 1986.  This function is currently to achieve and maintain "stability in the general level of prices".  The function proposed is broader, being to maintain price stability while also "maintaining an exchange rate that is conducive to real export growth and job creation".
