The Environmental Damage (Prevention and Remediation) Regulations 2009 implementing the Environmental Liability Directive were laid before Parliament on 2 February 2009 and come into force on 1 March 2009. The Regulations are based on the ‘polluter pays principle’ requiring those responsible to prevent and remedy environmental damage. For further information: Guidance documentation
Separate regulations for Northern Ireland, Scotland and Wales are also expected to come into force during 2009.
The European insurance and reinsurance federation (CEA) produced a paper last year (February 2008): “Environmental Liability Directive: Enhancing sustainable insurance solutions", which considers building blocks for possible EL insurance products.
