This long-awaited legislation was signed into law by President McAleese in July 2010. However the provisions of the Act will not come into force until formal Ministerial Orders are made and administrative arrangements put in place to change the Adoption Board into the Adoption Authority. The Act operates to codify existing adoption laws in Ireland and also gives effect to the Hague Convention on Inter-Country Adoption in Ireland. There are transition provisions in the Act to facilitate those who obtained declarations of suitability prior to the Act coming into force adopting abroad under the current law. However the Act did not implement many recommended reforms to modernise adoption law and procedures in Ireland and it will not affect the issue of under-resourced services in the area of adoption.
