Minnesota Governor Mark Dayton (D-Farmer-Labor) has recently signed legislation (H.F. 1) that would expedite the state’s environmental permitting process by allowing permit seekers to prepare their own environmental impact statements. It also requires the Minnesota Pollution Control Authority and the Minnesota Department of Natural Resources to issue environmental and resource management permits within 150 days of the completed application process. Applicants will be able to begin constructing or installing their projects before either a CWA NPDES or state disposal permit has been completed, provided they do not operate the system or discharge pollutants into state waters until the plans have been approved.
