Yesterday, we alerted that a coalition of industry groups, including the National Association of Manufacturers, the American Fuel & Petrochemical Manufacturers, and Great American Insurance Company, filed a lawsuit in the U.S. District Court for the Northern District of Texas seeking a preliminary injunction of the U.S. Occupational Safety and Health Administration's ("OSHA") enforcement of the anti-retaliation provision in the agency's final rule titled "Improve Tracking Workplace Injuries and Illnesses" before the rule takes effect on August 10, 2016. Today, OSHA announced it will delay the effective enforcement date of the anti-retaliation provision of its new injury reporting rule to now begin November 1, 2016. OSHA indicated that it intends to conduct additional outreach and provide educational materials and guidance to employers during this time period.
