EPA has issued a proposed rule amending the greenhouse gas (GHG) reporting rule that took effect December 29, 2009. 75 Fed. Reg. 48,743 (8/11/10). The proposed amendments would (i) provide additional information and clarity on existing requirements, (ii) allow greater flexibility or simplified calculation methods for certain sources at a facility, (iii) amend data reporting requirements to provide additional clarity on when different types of GHG emissions need to be calculated and reported, (iv) clarify terms and definitions in certain equations, and (v) make technical corrections. A challenge to the current rule by the American Petroleum Institute and other industry trade groups is pending before the D.C. Circuit Court of Appeals. EPA will accept comments on the proposed amendments until September 27, 2010.
