The State Intellectual Property Office ("SIPO") has issued the Work Plan for the Special Action of Patent Law Enforcement and Right Protection in the E-commerce Sector (the "Plan").

The Plan indicates that the SIPO, local bureaus of the SIPO and all right protection centres have reasonably allocated their tasks in connection with the special action, constituting a nationwide coordinated working network whose responsibilities are clarified and key tasks are highlighted. The working manners are classified into the following four circumstances: (i) quickly deleting or blocking links to infringing products in relation to obvious infringing activities; (ii) deleting or blocking as quickly as possible links to infringing products in relation to relatively complex patent infringing activities with reference to the advisory opinions on infringement determinations; (iii) timely deleting or blocking links to infringing products and closing down online stores in relation to complex patent infringing cases in accordance with the mediation documents or settlement decisions; and (iv) investigating and punishing activities of counterfeiting patents of others in the e-commerce sector.
