Tesco Stores v Highland Council and Asda Stores

Case in which Tesco challenges out of centre planning permisson granted to Asda for the development of a supermarket and petrol station in Tain. Tesco challenged the decision (1) on the basis of an alledged failure on the part of the Councl to apply the relevant retail policies, in particular the sequential approach, to selecting locations for retail uses and (2) because they claimed certain councillors had voted in favour of Asda application purely to stop or undermine a Tesco application for a town centre development. Both arguments were rejected by Lord Malcolm.
