BIS has published the draft new section 51A CCA, which will:
- ban issuers from sending credit card cheques unless the customer asks for them;
- clarify the request can come entirely from the customer or can be in response to an offer. The customer will not be considered to have asked for cheques simply by not saying they do not want them; and
- not allow customers to make ongoing regular requests for cheques.
Breach will be punishable by a fine or imprisonment. The Government wants to introduce the ban in its proposed Financial Services and Business bill in November. BIS welcomes comments on the draft
