R (T) v Sheffield CC  EWHC 2953 (Admin)
This was another challenge to a decision to cut services, this time subsidies to 20 local nurseries.The challenge included the familiar grounds of inadequate consultation and failure to comply with the PSED. These grounds were dismissed.
There were three further grounds of challenge, all of which failed. One particular such ground was that the LA had failed to comply with its duty to obtain best value, on the basis that (it was alleged) the LA had not properly considered the social value of the community nurseries. This ground was also dismissed. Social value was expressly referred to in the briefing paper, and a witness statement from one of the Councillors explained the council’s thinking on best value in this context.
