On 1 April 2011, the Competition Appeal Tribunal (“CAT”) handed down its judgment on appeals by Eden Brown, CDI and Hays against the fines imposed by the OFT for breach of the Chapter I prohibition of the Competition Act 1998. The CAT has concluded that the fines imposed were, overall, too high for conduct of the scale and impact of the infringement (albeit that it was a very serious infringement).
