• Employers need to take steps to ensure that their employees are entitled to the additional holiday entitlement coming into effect in October 2007 and April 2009. If you already give employees 28 days holiday this entitlement will be unaffected by the new legislation. However, if employees are currently only entitled to 20 days (including bank holidays) amendments will have to be made to the employee’s terms and conditions of employment.
  • Employers need to remember that employees are entitled to the increase between October 2007 and April 2009 proportionally depending on when a leave year starts. The DBERR website provides a useful guide on how to calculate the leave entitlement during this period.
  • The safe option will be to calculate entitlement for part time employees pro rata, regardless of whether they work on a bank holiday or not.
