Amendment No.5 (the "Amendment") to the Employment (Jersey) Law 2003 (the "Law") is currently with the Privy Council. We expect to hear more about the Amendment in Spring 2010. Article 6 of the Amendment would remove the age cap on unfair dismissal claims. Currently, under the Law, persons who have reached retirement age are prevented from bringing a claim for unfair dismissal to the Tribunal by virtue of the upper age limit in Article 74.
