The claimant was employed as CEO of all three of the respondent companies. There was no appearance by the respondents at the hearing. The claimant received an email in November 2008 stating that all staff including himself were to be temporarily laid off. Mr Farrell was issued with an RP50 and P45 in December 2008. In early 2009 he discovered that former colleagues had continued in employment. The Tribunal found that the claimant was unfairly dismissed and awarded Mr Farrell €156,000. He was also awarded €10,600 in respect of holiday pay under the Organisation of Working Time Act 1997 and €9,200 under the Minimum Notice and Terms of Employment Acts 1973 - 2005.
