The FMLC has looked at the uncertainty around the scope of the insider dealing offence under MAD. It says the MAD review should address the uncertainty caused by the Spector judgment over whether a person must deal "on the basis of" inside information in order to commit the offence, or merely needs to be in possession of the information at the time. Member States have taken differing views, with several, including the UK and Ireland, considering that a person merely in possession of the information would not be insider dealing if the information did not influence the decision to deal.
