On September 1, 2016, following a period of public consultation, the Canadian Nuclear Safety Commission (CNSC) has published regulatory document REGDOC-2.13.2, Import and Export. The CNSC regulates the use of nuclear energy and materials to protect the health, safety and security and the environment; to implement Canada’s international commitments on the peaceful use of nuclear energy; and to disseminate objective scientific, technical and regulatory information to the public.

Regulatory document REGDOC-2.13.2, Import and Export, sets out the CNSC’s guidance for current and prospective licensees who intend to import or export nuclear and nuclear-related dual-use items, also known as controlled nuclear substances, equipment and information. The latter are identified in the Nuclear Non-proliferation Import and Export Control Regulations (NNIECR). The legislation relevant to the import and export of these items is provided, along with an overview of the domestic and international contexts that form the basis of import and export controls for these items. The licensing program is outlined and information is provided on how to apply for a licence and amend an existing licence, and on application processing times.

This document examines the type of information the CNSC considers when assessing applications for the import or export of controlled nuclear substances, equipment and information. Further information is also provided for exporters on the end-use control, which allows the CNSC to require a licence for items that are not otherwise listed in the NNIECR when they may be intended for use in connection with a nuclear weapons program. It also identifies a change to how Canada’s nuclear non-proliferation policy applies to evaluating export applications for foreign-origin uranium.

Finally, the CNSC’s activities to verify and enforce regulatory compliance are considered. The document provides information about the CNSC’s import and export control program with respect to licence applications, the licence evaluation process and compliance with regulatory requirements.
