The Canadian Intellectual Property Office (CIPO) has moved forward with a plan to facilitate the expedited approval of patents for green technology. According to a CIPO Q&A release, the amendments to the Patent Rules accomplish the following:

  • expand the criteria of eligibility for advanced examination to applications that relate to a field of green technology; and
  • accelerate the overall process of advanced examination by encouraging applicants to avoid any undue delays during prosecution.

The amendments were announced in Part II of the Canada Gazette on March 16, 2011 and seem likely to be in response to the highly successful Green Technology Pilot Program put in place in the U.S. by the United States Patent and Trademark Office. If the American program is any indication, the Canadian green technology industry is likely to benefit significantly from the changes.
