The Department of Trade and Industry (DTI), now superseded by the Department for Business, Enterprise and Regulatory Reform (BERR), published in May 2007, a consultation seeking views on draft Consumer Protection from Unfair Trading Regulations, which will implement the Unfair Commercial Practices Directive, (Directive 2005/29/EC). The DTI’s consultation also included draft Business Protection from Misleading Marketing Regulations. These will replace the Control of Misleading Advertisements Regulations 1988 and will implement the Misleading and Comparative Advertising Directive 2006. BERR has now published a document which sets out the Government’s formal response to the comments received to the consultation on the two sets of draft Regulations. It records the key issues raised by the consultation responses and sets out the changes the Government is making to the Regulations.
