On 6 August 2011, details were published in the Official Journal of an action brought by the Italian company Italmobiliare to challenge the Commission’s decision to request information in relation to an investigation in the cement industry. Italmobiliare claims that the Commission’s decision should not have been addressed to it as a mere financial holding company and that the decision failed to state reasons, breached the principles of proportionality, legitimate expectations, audi alteram partem and sound administration, and went further than permitted by the powers granted to the Commission under Article 18 of Regulation 1/2003.
