A number of statutory instruments under the Banking Act 2009 have been published. All the instruments took effect on 21 February but were published on 25 March:  

  • the Banking Act 2009 (Bank Administration) (Modification for Application to Multiple Transfers) Regulations 2009 apply Part 3 of the Act where Treasury makes more than one partial transfer instrument;  
  • the Banking Act 2009 (Parts 2 and 3 Consequential Amendments) Order 2009 amends various legislation to take account of definitions in the Banking Act;  
  • the Banking Act 2009 (Third Party Compensation Arrangements for Partial Property Transfer) Regulations specify provisions which must, or may, be included in a third party compensation order made under the Banking Act in the case of a partial property transfer. They particularly apply to creditors of a banking institution immediately before a partial property transfer; and  
  • the Banking Act 2009 (Restriction of Partial Property Transfers) Order restricts the making of partial property transfer instruments and orders under the Banking Act 2009 and protects certain interests including security interests, set-off arrangements and netting arrangements.
