On 4 November 2013, the ACCC published its quarterly report for June to September 2013. Of note, the report observes that there has been an increase in non-compliance by recipients of compulsory information gathering notices issued pursuant to s155 of the Competition and Consumer Act 2010. Instances of non-compliance included the provision of late, inaccurate or incomplete responses to requests for information. 

The ACCC has indicated that it will closely monitor compliance with the investigative process under s155 and, in appropriate circumstances, it will consider making referrals to the Commonwealth Director of Public Prosecutions.
