On 13 July 2011, the General Court handed down its judgments in the appeals by companies of the Otis, KONE, Schindler and ThyssenKrupp groups against the Commission’s decision finding that they had infringed Article 101(1) of the TFEU by participating in a price-fixing, market-sharing, information exchange and bid-rigging cartel in the markets for the installation and maintenance of lifts and escalators in Belgium, Germany, Luxembourg and the Netherlands between 1995 and 2004. The General Court dismissed in their entirety the appeals by the Otis, KONE, and Schindler group companies. However, it has reduced the fines imposed on the ThyssenKrupp group companies because the Commission erred in increasing their fines by 50% on the mistaken grounds that ThyssenKrupp was a repeat offender.
