Following an internationally co-ordinated investigation into alleged cartel practices in the market for marine hoses, a number of arrests were made by the Department of Justice (DoJ) in the USA. The investigation included dawn raids of premises in the UK, as well as a criminal cartel investigation and the first use of the right to search a residential home under the OFT’s criminal investigation powers. The OFT has announced that the DoJ received guilty pleas from three UK executives for their part in anti-competitive activities. It is understood that, as part of the plea agreements, the three UK nationals will be returned to the UK to plead guilty to the Cartel Offence (under the Enterprise Act 2002) and submit to the OFT’s criminal cartel investigation.
