The European Commission has recently completed a review of the application of EU rules on temporary agency work (Directive 2008/104/EC). It confirmed that all Member States had adopted measures to implement the Directive, substantially fulfilling its purpose, and there is currently no need to propose any amendments to the Directive.
However, the Commission has identified two areas requiring further work by Member States:
- Whether certain derogations from the principle of equal treatment allowed by the Directive are being improperly used; and
- Restrictions on the use of temporary agency work in some Member States are in need of further review with a view to their removal in some cases.
