The New Brunswick government has introduced draft legislation amending the General Regulation 91-191, made under the Occupational Health and Safety Act, to include provisions regarding workplace violence and harassment. The deadline for the public to provide feedback on the proposed law was 16 May 2018. If passed, the amendments will take effect on 1 September 2018.
The amendments will require employers to establish a written code of practice with respect to workplace violence and harassment, in order to ensure the health and safety of their employees. Similar to violence and harassment laws in most Canadian provinces, employers will be required to conduct a workplace violence risk assessment and develop measures and procedures for incident reporting, investigations and summoning immediate assistance. The code of practice will need to be developed and implemented in consultation with joint committees and reviewed annually or more often if necessary. Employers will also be required to implement a training programme on the code of practice for all employees and supervisors.
At present, New Brunswick is the only Canadian province that does not address workplace violence or harassment in its occupational health and safety legislation.
