On 27 October the CAT published their decision on the disclosure of OFT documentation to four parties appealing the OFT's decision in April 2010 to impose fines on tobacco manufacturers and retailers for breaching Chapter I of the Competition Act 1998 in relation to tobacco retail pricing.

Before the CAT can approve a disclosure application it must be satisfied that disclosure is necessary, relevant and proportionate to the determination of the issue in question. The request by Imperial Tobacco, Morrisons, Safeway and Asda for documentation relating to the OFT's decision not to make a finding of infringement against Tesco was deemed irrelevant to the matter before the CAT and the applications for disclosure were dismissed.
