The fourth Pacific island to join the WTO, Tonga formally acceded to the WTO on 27 July 2007. Under Tonga’s terms of accession, Tonga has bound all its tariff lines at 15% or 20%a nd has agreed to commitments in 11 service sectors. It has also agreed to eliminate all industrial subsidy schemes prohibited under the WTO upon date of accession. One striking feature of the accession terms is the TRIPS+ linkage of patent status and data exclusivity. TRIPS+ are additional commitments over and above those already provided for in the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). For Tonga, it means that no generics can be approved during the patent term, effectively preventing compulsory licensing and government use orders.
