Mexico’s Energy Reform
Amendments to the Foreign Investment Law
On August 11th 2014, a Decree amending the Foreign Investment Law (“FIL”) was published in the Official Federal Gazette. It will become effective on August 12th 2014.
The amendments to the FIL are the result of the energy reforms that were approved when the Constitution was amended in December 20th 2013.
With the reform to the FIL, activities that comprise the basic petrochemical industry are no longer deemed strategic activities reserved to the Nation. In addition, oil and hydrocarbon exploration and extraction, as well as the planning and control of the national power industry, will remain reserved to the Nation, but now in accordance with the Constitution (that was amended) and the corresponding secondary laws.
Free participation by foreign investors is now allowed with regard to the marketing of gasoline and the distribution of liquefied petroleum gas as well as in the construction of ducts for the transportation of oil and oil byproducts, as well as in the drilling of oil and gas wells.
