Following the immediate implementation last week of new UK Border Agency Tier 4 guidance on conclusion of its consultation over the criteria for highly trusted sponsor status ("HTS"), the UKBA has published its response to feedback from the sector.

The response provides further information on how the UKBA will consider institutions' refusal/enrolment/course completion rates and confirms that its "sponsor management system" is in the process of enhancement to allow sponsors to view whether a migrant’s visa or extension application is successful.

It also provides some assurance that the UKBA would, where necessary, engage in a dialogue with institutions who are classed as "near misses" under the UKBA's new crieria with a view to assisting in improving their performance.
