Judge Matthew F. Kennelly has dismissed an antitrust class action filed against the major wireless carriers. The plaintiffs accused the wireless carriers of price-fixing text messaging rates. The Court found that the plaintiff's conspiracy allegations were insufficient. In dismissing the complaint, the Court noted that there was no allegation that the defendants had fixed prices for bundled text messaging plans - only per message unbundled rates - and it was plausible that the carriers kept per message unbundled text message rights high in order to persuade consumers to purchase bundled text messaging plans.
