On 24 March 2010, the European Commission published a new insurance block exemption regulation (BER). The new BER which came into force on 1 April 2010 is more limited than its predecessor, renewing only two of the four categories of agreement currently exempted, namely arrangements for the exchange of statistical information (compilations, tables and studies) and the creation and operation of (re)insurance pools, with some amendments.

Agreements on standard policy conditions or agreements on security devices are excluded from the new BER, though the Commission intends to address both of these types of agreements under the EU Guidelines on horizontal cooperation agreements, which are currently under review.  

The new BER will be valid until 31 March 2017.
