The Defend Trade Secrets Act has been introduced in the U.S. Senate. If passed, new statutory remedies for trade secret protection would be implemented. As proposed, the law would provide for specific damages for the loss of trade secrets, including attorney’s fees and punitive damages. It would also provide for an almost immediate mechanism to allow for the seizure of misappropriated trade secrets. This would be a significant change to common practice.
