FSA is consulting on how FCA will use its power to publish information about the content of a warning notice. The purpose of the power is to promote early transparency of enforcement proceedings and FSA proposes that FCA will normally publish a statement whenever it has issued a warning notice to which the power applies. The power applies when FCA proposes a disciplinary outcome to proceedings. The exception to the rule will be if publication would be unfair to the person the notice relates to, prejudicial to consumer interest or detrimental to UK financial system stability. As FCA will adopt the Enforcement Guide (EG), changes to explain how it will exercise these powers will be made to Chapter 6.
