Where a claimant sought damages arising from a negligent property buyer's survey on behalf of other owners and users of the property, it was necessary to join those others under CPR 19.5 after the expiry of the limitation period. The claim was one for losses suffered by all of the relevant parties, including associated costs and damages for loss of amenity and inconvenience, and joinder did not raise any new claims. It was necessary because the defendant had asserted that if liability in relation to diminution in value were established, the claimant would only be entitled to part of the value of that diminution (J P Tupper Associates v Pearson-Chisman Kitchin J 23 May 2011).
