- The European Court of Justice has issued a judgment in relation to the assessment of an agreement requiring licence royalties to be paid on the basis of patents that had subsequently been revoked. The ECJ concluded that Article 101 does not preclude a requirement on a licensee to pay royalties in these circumstances, provided that the licensee was able to terminate the agreement on reasonable notice.
