Last month we discussed two lawsuits the EEOC recently filed on behalf of a gay and lesbian employee. This month the EEOC adopted a fact sheet from OSHA on restroom use – Best Practices: A Guide to Restroom Access for Transgender Workers. The guidance says that, when deciding which bathroom to use, employees should determine the most appropriate and safest option. The guidance discusses the best policies and alternative options that employers can make available. It also advises that all employers need to find solutions that are safe, convenient, and respect transgender employees.
