On 29 November 2012 the NCCIR adopted a Decision which approved the new version of the Main Conditions for the Telecommunication Services Agreement (Main Conditions). The previous version of the Main Conditions dated 26 March 2009 was repealed by the same Decision and the new Main Conditions took effect on 8 January 2013. The new Main Conditions set the various requirements for the telecommunication services agreements, defining mandatory conditions and imposing certain restrictions. The new Main Conditions do not establish any radically new framework for the telecommunication services agreements. However, the sections regarding the rights and obligations of the parties, essential conditions of the agreement and liabilities of the parties have been modified and detailed, filling gaps in the previous version of the Main Conditions. In particular, the previous version of the Main Conditions did not contain any particular provisions in respect of liability. The new Main Conditions make reference to the provisions established by the new Telecommunication Services Rules which became effective on 23 April 2012. Those provisions regulate the liability of the consumers under telecommunication services agreements as well as the liability of the providers.
