On September 26th, the Consumer Financial Protection Bureau published an interim final rule governing the issuance of temporary cease-and-desist orders ("TCDO") pursuant to Section 1053(c) of the Dodd-Frank Act. The interim rule follows the FDIC's approach and addresses the basis for issuing a TCDO; the content, scope, and form of a TCDO; the procedures governing the issuance of a TCDO and the remedies available to the Bureau in issuing a TCDO; and the rights of persons subject to a TCDO. The interim final rule is effective immediately. Comments should be submitted on or before November 25, 2013. 78 FR 59163.
