The Agency Workers Regulations 2010 have now been published and are due to come into force on 1 October 2011. The Regulations give new rights to agency workers after 12 weeks’ work including:  

  • paid holiday entitlement  
  • the right to bring a claim in the employment tribunal  
  • contractual entitlements directly linked to the work undertaken, for example payment for overtime, shift allowances, payments for dangerous duties  
  • detrimental treatment or dismissal of agency workers on the ground of their status is prohibited.
