12/12/13: “Calif. Do-Not-Track Law Will Have National Impact”

A “Do-Not-Track” amendment to the California Online Privacy Protection Act (CalOPPA) may establish a legal standard for data privacy and security, particularly since there is no national legal standard. Gov. Jerry Brown signed the amendment on Sept. 27 which requires online businesses collecting personally identifiable information to disclose how they respond to consumers’ “Do-Not-Track” directives.  Website operators are now obligated under law to provide a “clear and conspicuous hyperlink in the operator’s privacy policy to an online location containing a description, including the effects, of any program or protocol the operator follows that offers the consumer that choice.” An online service that either inaccurately describes the disclosures, or fails to update the disclosures, may incur liability for deceptive practices, along with penalties of $2500 per violation. The law activates on January 14, 2014, and allows website operators 30 days to bring their sites into compliance.

12/12/13: “Fuel Economy of New Vehicles Sets Record High / Fuel Economy Gains to Continue Under President Obama’s Clean Car Programs”

The Environmental Protection Agency’s (EPA) annual report of the average fuel economy of vehicles sold in the United States shows the model year 2012 vehicles achieved an all-time high fuel economy of 23.6 miles per gallon (mpg), which represents a 1.2 mpg increase over the previous year.  An increase in fuel economy is expected to double by 2025 and cut vehicle greenhouse gas emissions by half with Obama administration’s historic National Clean Car Program standards.

12/11/13: “Regulation stays on F&I forefront for 2014”

Auto finance regulation will remain a focus for the Consumer Financial Protection Bureau in 2014. The CFPB began investigations this year into dealership retail practices such as dealer reserve and dealer markup systems. Ally Financial Inc., American Honda Finance Corp., and Toyota Motor Credit Corp. all disclosed filings with the SEC that they were under CFPB review. It was revealed the CFPB does not want lenders to allow dealers to determine their own compensation, and suggested lenders should switch to paying dealerships flat fees, flat percentages of the amount financed, or a combination of the two. Opponents say flat fees could raise the cost of credit for consumers.

The California Department of Motor Vehicles released a press release that announced proposed regulations governing the testing of self-driving and autonomous cars on California's public roadways have been published in the Office of Administrative Law's California Regulatory Notice Register.

LITIGATION UPDATES

12/6/13: BMW of North America, LLC v. Tanda Management, LLC

BMW of North America (“BMW”) seek injunctive and monetary relief from Tanda Management, dba Lucas Car, Tyger Lucas, and Anya Lucas (“Tanda”) for allegedly infringing on BMW’s trademarked roundel logo. According to complaint, Tanda used BMW’s Roundel logo in their advertisements, on their building, in business signage, and on employee uniforms. BMW prays for treble damages and for Tanda to be required to deliver unto BMW for destruction all material articles bearing the infringing BMW Roundel logo.

12/5/13: “Cupertino couple indicted on charges of running scam through Sunnyvale luxury car business”
Yujen and Maria Chen, operators of 888 Auto Corporation in Sunnyvale, face 24 felony charges including wire fraud, international money laundering, identity theft, and exporting stolen vehicles. According to the U.S. Department of Justice, the Chens allegedly recruited acquaintances to lease vehicles, paying them up to $500 to participate. Next, they would take possession of the vehicle and promise to make car the payments. The couple would then export the vehicles to Asia and fail to pay off the lease obligations. DMV documents were also allegedly altered to facilitate the scheme; fraud damages are calculated to be at least $3.3 million. Penalties for each of the 24 charges carry 2 to 20 years imprisonment, as well as fines and restitution.

12/2/13: “Whose BladeGlider: A legal sword fight”
Delta Wing Project 56, a company backed by racing magnate Don Panoz, is suing Nissan over the origin of its BladeGlider concept, claiming the automaker copied the design of its DeltaWing vehicle from 2012. Nissan’s BladeGlider debuted at the Tokyo Motor Show last week and features a similar triangular shape. The civil suit filed by Panoz’s lawyers on November 22 seeks a cease-and-desist order to be levied on Nissan, barring the Japanese automaker from displaying, racing, or selling cars with such a design. Panoz said that if Nissan is able to race and sell its wedge-shaped cars, the DeltaWing’s shape will enter the public domain of automotive design.

12/2/13: “Ford Gets New Court Hearing on $445 Million Interest Bid”
Ford Motor Co. will get a new hearing in its bid to collect $445 million in interest on overpaid taxes after the U.S. Supreme Court told an appeals court to reconsider its previous upholding of the IRS’ method of calculating the interest. Ford deposited money with the IRS to cover possible underpayments for tax years 1983 through 1994. Later, the company requested the IRS treat the money as an advance payment toward any additional taxes the automaker might owe. Currently, Ford argues the interest on the overpayments should have started when the automaker initially deposited the money, whereas the IRS says the starting date should be when Ford told the agency to treat the money as an advance payment.

12/2/13: “At Request of FTC - Telemarketer Ordered to Pay $5.1 Million to Reimburse Victims of Car-Buying Scam”

A federal court has ordered a Canadian telemarketer to pay more than $5.1 million to American and Canadian consumers who were scammed into paying hundreds of dollars based on false claims that the telemarketer had buyers lined up for their cars, and that refunds would be provided if the cars weren’t sold.

11/26/13: “9th Circuit Will Not Revive Class Action Over Prius Defect”

The Ninth Circuit on Wednesday refused to revive a putative class action accusing Toyota Motor Corp. of not fixing its Prius vehicles, ruling a fuel-tank defect that caused inaccurate gas gauge readings in cold weather wasn't covered by Toyota's warranty.

11/21/13: Affinity Labs of Texas, LLC. v. Volvo Cars of North America, LLC

Affinity Labs of Texas (“Affinity Labs”) brings suit against Volvo Cars of North America (“Volvo”) for allegedly infringing upon its patents by manufacturing and selling vehicles, including the Volvo SC60, with sound systems that are able to wirelessly pair with a portable electronic device, such as an MP3 player or cell phone. Affinity Labs claims Volvo does not have the license or permission to use such patents.

11/21/13: “Takata officials to plead guilty in U.S. price-fixing case –govt”

Takata executives Yasuhiko Ueno, Saboro Imamiya, and Yoshinobu Fujino will all plead guilty to conspiring to fix the price of seatbelts sold to automakers in the U.S. and will serve 14 to 19 months in jail. Takata settled antitrust charges with the Justice Department in October for $71.3 million. Other companies which bought parts subject to price fixing are Chrysler, Ford, General Motors, and Mitsubishi. In some cases, price fixing lasted for 10 or more years.

12/11/13: “Advantage picks buyer, settles vehicle lease deal with Hertz”

Advantage Rent A Car picked Catalyst Capital Group to purchase its assets in bankruptcy proceedings and said it reached a deal with Hertz which allows Advantage to continue using a leased vehicle fleet. Catalyst was also handed the option to buy the leased vehicles from Hertz. Advantage filed for bankruptcy in November following the termination of its vehicle lease agreements with Hertz due to its failure to make payments on 24,000 vehicles. A final hearing is scheduled for 12/17 for the sale of Simply Wheelz LLC, dba Advantage Rent A Car.

12/9/13: “We just sold our very first vehicle with Bitcoin as payment!”

Lamborghini Newport Beach sold its first vehicle, a Tesla Model S Performance, via Bitcoin payment. Bitcoin is a peer-to-peer electronic currency developed in 2009 which uses cryptography to secure transactions. Lamborghini Newport Beach writes, “[we] are proud to announce that we are fully capable of accepting Bitcoin as payment for vehicles. We are excited to be opening the door to this new currency.”

12/9/13: “Group 1 Automotive Acquires Six Franchises in Columbus, Georgia”

Group 1 Automotive announced the acquisition of Jay Automotive Group, Inc. in Columbus, Georgia which includes, Jay Toyota Scion, Jay Buick GMC, Jay Subaru of Columbus, Jay Mazda, and Volvo of Columbus. The dealerships are expected to generate $150 million in estimated annual revenues.

12/9/13: “Want to sell a vehicle? Attach a video”

Data from Google indicates more than 50% of all car shoppers watch at least 30 minutes of video during the buying process, and 1 in 4 watches an hour or more. Similarly, AutoTrader.com data shows shoppers are 20%more inclined to click on a specific vehicle listing if it has a video. Dealers are beginning to attach short videos to their Internet vehicle postings as a way to increase business. Dealer Dave Wright says salespeople at Dave Wright Nissan-Subaru in Cedar Rapids, Iowa, shoot a 55-second vehicle video for every prospective customer that calls, e-mails, or visits the dealership, and says the video requirement increased his sales and “nudged salespeople to become more response.”

12/5/13: “Honda Offers Dealers Incentives to Spur Sales”

Honda Motor Co. said it will pay bonuses of $3,000 for each vehicle sold above their December 2012 sales total. The incentive is coming off a tough November where Honda saw its new vehicle sales slump while their rivals posted double-digit percentage increases. The number to beat for Honda dealers this December is 116,740 vehicles. To put in perspective, a dealer who sold 100 cars in December 2012 and sells 120 this year will receive a bonus of $60,000.

Steve Saleen announced his automotive company is planning to produce an electric vehicle. 12/4/13: “Tesla gets win in Ohio dealer fight”

Ohio lawmakers declined an amendment which would prohibit the company’s sales model. The amendment, backed by the Ohio Auto Dealers Association, sought to prohibit automakers from owning dealerships. Tesla will open its first Ohio dealership in Easton on Friday, followed by a Cincinnati opening next week.

11/25/13: “Chrysler IPO is delayed”

Fiat announced the Chrysler Group will delay its plans for an IPO until Q1 of 2014. The shares to be sold are currently held by a union-controlled trust fund established in 2007 to pay health care costs for Chrysler retirees. The trust was never intended to obtain a 41.5 percent stake in the automaker, but when the company’s coffers ran dry in 2008, the only asset it could offer was its own stock.

11/21/13: “Chrysler Banks Said to Mull IPO Valuation of About $10 Billion”

Chrysler Group LLC’s advisers are discussing a valuation of between $10 billion and $11 billion for the carmaker ahead of an IPO which could take place next month. Investment banks working the IPO considered a range between $9 billion and $16 billion as well. The United Auto Workers retiree trust and Fiat SpA are disputing the company’s value, while CEO Sergio Marchionne eyes the possibility of purchasing the trust’s stake. A $10 billion valuation would put the trust’s 41.5 percent share worth $4.15 billion – less than what analysts expect Fiat to pay. Marchionne has been trying to combine Fiat and Chrysler and compete with larger rivals. Control of Chrysler would also provide Fiat the capital to fund a turnaround in Europe.

11/20/13: “Honda shows concept for next fuel-cell car”

Honda unveiled a concept hydrogen fuel-cell vehicle at the Los Angeles Auto Show. The concept, which showcased the design direction of its next FCEV due in the U.S. and Japan by 2015, seats five and features an updated powerplant, with a 33 percent more compact design and 66 percent more power compared to the FCX Clarity which launched in 2008. Honda says the new car will also have a range of 300 miles on a single hydrogen fill-up.

11/20/13: “CA BOE Releases New Online Tool to Find Correct Sales and Use Tax Rates in CA”

California has a 7.5% base sales and use tax, but application of city, county, and district sales tax results in a confusing maze of tax rates varying by location and changing frequently. In an effort to reduce retailer errors and consumer complaints, the California State Board of Equalization released an online mapping tool, which provides the applicable tax rate upon entry of an address. Tax rates, as well as city and county boundary lines are subject to change.  Therefore, it is recommended retailers use the tool to easily find the current tax rate at a specific location.

11/19/13: “Daimler says to take 12 pct stake in BAIC Motor”

Daimler AG said it will take a 12 percent stake in BAIC Motor. Dieter Zetsche, chairman of the board and head of the Mercedes-Benz Cars unit, said, “The strategic investment proves our long-term commitment to China and our partner.” BAIC Motor will take 51 percent of the manufacturing joint venture with Daimler, while Daimler will take 51 percent of the sales joint venture with BAIC. Daimler also said the Chinese government has approved of the agreement.

11/13/13: “Musk’s next target for Tesla: Its own ‘F150’ pickup”

Tesla CEO Elon Musk said the automaker is five years away from offering a full-size pickup to compete with Fords F150. Musk said, “That’s the best selling car in America. If people are voting that’s their car, then that’s the car we have to deliver.” In the first nine months of this year, Ford sold 560,000 F-series pickups in the U.S., versus Tesla’s 14,000 Model S sedans.

11/13/13: “Ford Moves to Protect Logo From Allies of Toronto Mayor”

Ford said it will protect its Ford script and oval logo after supporters of Toronto Mayor Rob Ford made shirts emblazoned with the slogan, “Ford Nation” coupled with the automaker’s logo. A Ford spokesman said Ford never gave permission for use of its logo, and views the shirts as an unauthorized use of the trademark. Ford asked for supporters to cease using the logo.

11/20/13: “1,192 Yokohama 7.50R16 RY215 tires”

Yokohama Tire Corporation is recalling certain 7.50R16 RY215 tires manufactured 1/1/06 through 8/1/11 for failing to comply with the requirements of Federal Motor Vehicle Safety Standard, No. 119, “New Pneumatic Tires for Motor Vehicles with a GVWR of more than 4,536 kilograms (10,000 pounds) and Motorcycles.”  The affected tires are missing the required load/inflation markings, increasing the risk of a crash.

Porsche Cars North America, Inc. is recalling certain 2014 Boxster, Boxster S, Cayman, Cayman S and 911 Carrera (S, Cabriolet, S Cabriolet, 4, 4S, 4 Cabriolet, 4s Cabriolet) vehicles manufactured 9/2/13 through 9/23/13 for defective wiring harnesses in the passenger seat, which could cause the passenger air bags to be deactivated.

Chrysler Group LLC is recalling certain 20013-2008 Dodge RAM 2500 4x4 and 3500 4x4, 2007-2008 Dodge RAM 3500 4x2 Cab Chassis, and 2006-2008 Dodge RAM 1500 Mega Cab 4x4 trucks manufactured 2/12/02 through 2/13/08.  The left tie rod assembly in the affected vehicles may break, causing a loss of steering.
