The Australian Government yesterday released an exposure draft of the Competition and Consumer Amendment (Competition Policy Review) Bill. The Bill implements recommendations of the Harper Competition Review, including by amending section 46 of the Competition and Consumer Act 2010 (Cth) (CCA).
In response, the Department of Communications and the Arts released a consultation paper seeking comments on the ongoing operation of the telecommunications-specific anti-competitive conduct laws in Part XIB of the CCA, given their interaction with section 46 of the CCA. Specifically, the Department is seeking feedback on whether the Part XIB provisions should be amended in light of the proposed changes to the general competition law.
Submissions in response to the consultation paper are due by 30 September 2016.
