LabMD is once again challenging the Federal Trade Commission’s authority to police companies’ data security practices, this time in Georgia.  Following a rejection of its arguments by the FTC itself, a dismissal of its petition to the Eleventh Circuit on jurisdictional grounds, and its own dismissal of a lawsuit it brought in federal district court in Washington, D.C., LabMD has now filed a new complaint in a federal district court in Georgia.  Whether this southerly venue proves more hospitable remains to be seen. But now that a federal court in New Jersey has rejected a similar challenge by Wyndham Hotels & Resorts (more on that next week), LabMD alone is carrying the water for companies that want to see constraints put on the FTC’s data security campaign.
