Germany's constitutional court has received a complaint alleging that the unitary patent and the unitary patent court break German law. It is still unknown who submitted the complaint, but the constitutional court has taken the complaint seriously and has thus at the moment put an end to further progress in ratifying the UPC (Unitary Patent Court) Agreement.
This does not mean that the UPP (Unitary Patent Protection) and UPC have been cancelled for good. Earlier estimates that the UPP and the UPC would enter into force late this year or early next year, will instead need to be revised. Further delays are thus most likely to be expected.
